Job Summary

The Commercial Manager shall be responsible for the pre and post contract management of the projects, including budget preparation. He/she shall be well versed in the FIDIC suite of contracts (Yellow Book, Red Book, White Book, etc.). The Commercial Manager shall be reporting to the Commercial Director.

Key Duties and Responsibilities

  • Prepare the tender documents for construction works and consultancy services in coordination with the Development and Project Teams.
  • Review the prequalification of the contractors and consultants for the purpose of tender, including the preparation of the necessary non-disclosure agreements;
  • Manage the contractor/consultant enquiry process during the tender period and incorporate responses into tender addenda.
  • Perform tender evaluations, tender reporting, and prepare recommendations to award reports for stakeholders’ approval. Ensure that the technical evaluation has been received from the technical department to be inserted in the recommendation.
  • Review and validate the bidders’ comments against the standard terms and conditions of the contract and negotiate any diversions and qualifications.
  • Review the cash flow, cost plan (during the tender stage), pre-tender estimates, and project budget and provide comments.
  • Prepare the company’s monthly cost report to be submitted to the CFO and COO.
  • Provides input for the day-to-day commercial and contractual administration including review of the evaluation of claims and/or contract variations, including drafting of any contractual correspondences.
  • Closely monitor the company policy and procedure with regards to delegation of authority (DOA) relating to approval on procurement, contract award, variation orders, payment, etc.
  • Prepare interim payments and final payment certificates in line with all conditions of contract and company policies and procedures.
  • Review and validate the bank guarantees and insurances in line with the contractual requirements and set up a flagging mechanism for near-expiry documents.
  • Perform procurement duties for operation, including management of the procurement of FF&E, OS&E or Free Issue Goods (if any).
  • Prepare and issue construction contracts and consultancy agreements including operations agreements.
  • Review performance bonds and advance payment bonds submitted by the contractor and provide comment on the same. Advise if any comments or extensions are needed to such bonds.
  • Provide commercial advice to the project team where necessary.
  • Provide recommendations on penalties, liquidated damages and associated issues.
  • Manage the day-to-day commercial and contractual administration including review and evaluation of claims and/or contract variations;
  • Manage compliance of consultants, contractors, and operators with their contracted scope of services.
  • Manage claims review and determination (in conjunction with the engineer if in respect of the contractor).
  • Provide supervision and analysis of development and project risks and opportunities.
  • Manage the change management process within the company, the consultancies, and construction contracting environments.
  • Proactively leads, manages, and mitigates contractual and commercial risks with the development team, Consultants and Contractors.
  • Set up and manage the Earned Value reporting for financial institutions in relation to Escrow and funding arrangement.
  • Set up and manage the commercial workflows within Aconex and their implementation within the project team
  • Manage the commercial inputs for Pulse Platform.
